Terms of Service

1. Acceptance of Terms

By accessing, downloading, installing, or using the Kite Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. We reserve the right to refuse service to anyone at any time for any reason.

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet the eligibility requirements. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Service Description

Kite provides a Virtual Private Network () service that encrypts your internet connection, masks your IP address, and routes your internet traffic through secure servers across multiple global locations. The Service is designed to enhance your online privacy, security, and access to content. We strive to maintain high availability but do not guarantee uninterrupted or error-free service. Features, server locations, and available protocols may be modified at any time.

4. User Accounts

To use the Service, you must create an account by providing a valid email address or using third-party authentication (Google Sign-In or Sign in with Apple). You are solely responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access or use of your account
Ensuring that the information you provide is accurate and current

5. Subscription Plans & Payment

Kite offers various subscription plans (Lite, Pro, Max) with different features, traffic quotas, and device limits. Details of each plan are available on our pricing page.

5.1 Apple In-App Purchases (Auto-Renewable Subscriptions)

Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
Prices are in U.S. dollars (or local currency equivalent) and may vary by region. Price changes will be communicated in advance.

5.2 Other Payment Methods

We also accept payments via Stripe (credit/debit cards, Alipay, WeChat Pay) and cryptocurrency (USDT).
For Stripe subscriptions, recurring charges will be applied to your payment method at the beginning of each billing cycle.
You may cancel Stripe subscriptions at any time through your account dashboard. Cancellation takes effect at the end of the current billing period.
One-time purchase plans provide access for the purchased duration without automatic renewal.

5.3 Refund Policy

For Apple In-App Purchases, refund requests must be directed to Apple in accordance with Apple's refund policy.
For Stripe and other payment methods, we offer refunds on a case-by-case basis. Please contact support@kitevpn.net within 7 days of purchase.
Refunds are generally not available for partially used billing periods or if significant bandwidth has been consumed.

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

Use the Service for any activity that violates local, state, national, or international laws or regulations
Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Distribute malware, viruses, or any other malicious code through the Service
Engage in spam, phishing, social engineering, or any fraudulent activity
Attempt to gain unauthorized access to our systems, networks, or other users' accounts
Conduct DDoS attacks, port scanning, or any activity that disrupts network operations
Use the Service to infringe on intellectual property rights, including copyright and trademark violations
Share, resell, or redistribute your account access or subscription without authorization

7. Intellectual Property

The Service, including its design, features, and content, is owned by KiteTech Solutions LLC and is protected by intellectual property laws. All trademarks, service marks, logos, and trade names displayed on the Service are our property or the property of their respective owners. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KITETECH SOLUTIONS LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless KiteTech Solutions LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you transmit through the Service.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, if we believe you have violated these Terms or engaged in conduct that we determine to be inappropriate or harmful. Upon termination: (a) your right to use the Service will immediately cease; (b) we may delete your account data in accordance with our Privacy Policy; (c) provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

12. Apple App Store Terms

The following additional terms apply when you download or use the App through the Apple App Store:

These Terms are between you and KiteTech Solutions LLC only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
Apple has no obligation to provide any maintenance or support services for the App.
In the event of any failure of the App to conform to applicable warranties, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
In the event of a third-party intellectual property claim, KiteTech Solutions LLC (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of such claim.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government prohibited or restricted party list.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by posting the updated Terms on our website and within the App, and updating the "Effective Date" at the top. It is your responsibility to review these Terms periodically. Your continued use of the Service after the posting of changes constitutes your acceptance of such changes. If you do not agree to the modified Terms, you must discontinue use of the Service.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in San Francisco, California. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and KiteTech Solutions LLC regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
